Order on forced feeding of a starving person. Forced feeding
Forced feeding - the forcible procedure of introducing food into the body, which is now used primarily for fattening geese and ducks, but has also been applied and is being applied to people, representing the practice of feeding against their will. Forced feeding is carried out using special tubes (Eng. Gavage ), which are administered through the nose or mouth into the esophagus. Such nutrition can also be provided for medical reasons, and not just because the person deliberately refuses to eat. In some cases, force-feeding is possible due to mental disorders, when the patient refuses to eat due to the belief that the food is poisonous.
Force-feeding in prisons
This practice was widely used in prisons during prisoner hunger strikes, but the Tokyo Declaration of the World Health Organization 1975 years forbade the force-feeding of prisoners under certain conditions. According to this declaration, if a prisoner refuses to eat, feeding may be stopped, but only if at least two independent doctors confirm that the prisoner can reasonably and calmly consider the consequences of his refusal to eat, which doctors are obliged to explain to him.

Force-feeding girls in Africa
In parts of Africa and the Middle East, fat women are considered more elegant, beautiful and sensual. Thus, in these countries, a special diet leading to obesity, applied to girls from an early age, is common. Mothers force girls to eat large amounts of food so that they gain a lot of weight by marriageable age. Tubes are also used for force-feeding. To date, this practice is most common in Mauritania and Nigeria, where girls are especially fattened in the last months before marriage. In Mauritania, girls are forced to eat the fat from camel humps, which quickly causes dramatic weight gain. If girls refuse to eat, they are explained the need for this, and sometimes they are punished physically - for example, they beat them or pinch their fingers between two pieces of wood. There is a movement in contemporary Mauritania to abolish this custom, but it is a traditional practice that has taken root and is still present and an integral part of Nigerian and Mauritanian culture.
Forced fattening of animals
Force-fatting animals to gain weight is a widespread practice - camels, calves, chickens, and so on. Ducks and geese bred for the production of foie gras - enlarged livers - are especially heavily fattened. There are trends in various countries to ban forced feeding of animals as a practice that causes suffering.

An excerpt characterizing Force-feeding
Stella, huddled up, sat on a pebble and, sobbing softly, wiped her fist with her fist, still pouring, burning tears . .. Her whole fragile, shriveled figure expressed the deepest sadness ... her, so grieving, and so different from my usual “bright Stella”, I suddenly felt terribly cold and scared, as if, in one short moment, the whole bright and sunny Stella’s world had completely gone out, and instead of it we were now surrounded only dark, soul-crushing emptiness...
For some reason, Stellino's usual high-speed "self-deception" didn't work this time... Apparently, it was too painful to lose friends dear to her heart, especially knowing that no matter how much she missed them later, she would never see them again nowhere and never... It was not an ordinary bodily death, when we all get a great chance to incarnate again. It was their soul that died ... And Stella knew that neither the brave girl Maria, nor the "eternal warrior" Luminary, nor even the ugly, kind Dean, would ever incarnate, sacrificing their eternal life for others, perhaps very good, but completely them strangers...
Just like Stella, my soul hurt a lot, because it was the first time I saw in reality how brave and very kind people left of their own free will. .. my friends. And it seemed that sadness settled forever in my wounded childish heart ... But I also already understood that no matter how much I suffered, and no matter how much I wished it, nothing would bring them back ... Stella was right - it’s impossible it was to win at such a price ... But it was their own choice, and we had no right to refuse them this. And to try to convince them - we simply did not have enough time for this ... But the living had to live, otherwise all this irreparable sacrifice would have been in vain. And this was exactly what was not to be allowed.
– What are we going to do with them? - Convulsively sighing, she pointed to the kids who had huddled together, Stella. - You can't leave it here.
I didn't have time to answer when a calm and very sad voice sounded:
– I'll stay with them, if you'll let me, of course.
Together we jumped up and turned around - this was the man saved by Maria speaking... But somehow we completely forgot about him.
- How do you feel? – I asked as friendly as possible.
I honestly did not wish harm to this unfortunate stranger saved at such a high price. It wasn't his fault, and Stella and I knew that very well. But the terrible bitterness of the loss still clouded my eyes with anger, and although I knew that this was very, very unfair to him, I could not pull myself together and push this terrible pain out of myself, leaving it "for later" when I all alone, and, closing myself “in my corner”, I can give vent to bitter and very heavy tears ... I was also very afraid that the stranger would somehow feel my “rejection”, and thus his release would lose that importance and beauty victory over evil, in the name of which my friends died ... Therefore, I tried my best to gather myself and, smiling as sincerely as possible, waited for an answer to my question.
The man sadly looked around, apparently not quite understanding what had happened here, and what was happening to him all this time. ..
– Well, where am I?.. – he quietly asked in a voice hoarse from excitement. What is this place, so terrible? It doesn't look like what I remember... Who are you?
- We are friends. And you are absolutely right - this is not a very pleasant place ... And a little further, the places are generally wildly scary. Our friend lived here, he died...
– I'm sorry, little ones. How did your friend die?
"You killed him," Stella whispered sadly.
I froze, staring at my girlfriend... This was not said by the "sunny" Stella, who was well known to me, who "without fail" felt sorry for everyone, and would never make anyone suffer!.. But, apparently, the pain of loss , like me, aroused in her an unconscious feeling of anger “at everyone and everything”, and the baby was not yet able to control it in herself.
– Me?!.. – exclaimed the stranger. But that can't be true! I never killed anyone!..
We felt that he was telling the truth, and we knew that we had no right to shift the blame on him. Therefore, without even saying a word, we smiled together and immediately tried to quickly explain what really happened here.
The man was in a state of absolute shock for a long time... Apparently, everything he heard sounded wild to him, and certainly did not coincide with what he really was, and how he treated such a terrible, not fitting into the normal human framework, evil...
- How can I make up for all this?!.. I can't do it? And how to live with it?!.. - he clutched his head... - How many I killed, tell me!.. Can anyone say that? What about your friends? Why did they go for it? Well, why?!!!..
– So that you could live as you should... As you wanted... And not as someone wanted... To kill the Evil that killed others. Because, probably ... - Stella said sadly.
- Forgive me, dear ones... Forgive me... If you can... - the man looked completely killed, and I was suddenly "pricked" with a very bad premonition...
- Well, no! I exclaimed indignantly. “Now you must live!” Do you want to nullify all their sacrifice?! Don't even dare to think! Now you will do good instead of them! That will be right. And leaving is the easiest thing. And you no longer have that right.
The stranger stared at me dumbfounded, apparently not expecting such a violent outburst of "righteous" indignation. And then he smiled sadly and said quietly:
– How did you love them!.. Who are you, girl?
My throat was very tight and for some time I could not squeeze out a word. It was very painful because of such a heavy loss, and, at the same time, I was sad for this "restless" person, who would be oh so difficult to exist with such a burden...
- I am Svetlana. And this is Stella. We're just walking around here. We visit friends or help someone when we can. True, there are no friends left now...
– Forgive me, Svetlana. Although it probably won't change anything if I ask your forgiveness every time... What happened happened, and I can't change anything. But I can change what happens, can't I? - the man glared at me with his blue eyes, like the sky, and, smiling, with a sad smile, said: - And one more thing . .. You say that I am free in my choice? .. But it turns out - not so free, dear .. Rather, it looks like atonement for guilt ... With which I agree, of course. But it's your choice that I have to live for your friends. Because they gave their lives for me.... But I didn't ask for that, did I?.. Therefore, it's not my choice...
I looked at him, completely dumbfounded, and instead of “proud indignation” that was ready to immediately escape my lips, I gradually began to understand what he was talking about ... No matter how strange or insulting it sounded - but that’s all it was absolutely true! Even if I didn't like it at all...
Yes, I was very hurt for my friends, for the fact that I would never see them again... that I would no longer have our marvelous, "eternal" conversations with my friend Luminary , in his strange cave, filled with light and warmth... that laughing Maria will no longer show us the funny places found by Dean, and her laughter will not sound like a cheerful bell. .. And it was especially painful that instead of them there will now be live this complete stranger to us...
But, again, on the other hand, he didn't ask us to interfere... He didn't ask us to die for him. Didn't want to take someone's life. And now he will have to live with this heaviest burden, trying to “pay off” with his future actions the guilt, which in reality was not his fault ... Rather, it was the fault of that terrible, unearthly creature who, having captured the essence of our stranger, killed "right and left."
There are different situations in life when an adult cannot eat in the usual way. This happens mostly after surgery. During the recovery period, a person is unable to chew and rise to digest food. But also at this time, the patient needs a constant intake into the body for the functioning of all organs and the restoration of life. In this case, this type of food intake into the body, such as enteral nutrition, is used.
Enteral nutrition - what is it?
This is a type of patient therapy, its peculiarity is that food is delivered through a tube or a special system. Most often, special mixtures are used for this. They differ from the usual food for an adult, since in certain conditions the patient cannot take other foods.
The benefits of this type of nutrition
This type of nutrition has its own advantages for patients:
Indications for enteral nutrition
The development of medicine in the last two centuries has made it possible to determine what will be best for a person after surgery, methods that will help him recover faster and get the necessary strength with the least risk. So nutrition with mixtures after operations with the help of additional medical devices has its advantages and indications. There are certain indications specifically for the mixtures that a person needs, as well as for the very method of eating. Artificial nutrition is prescribed if:
- The patient, due to his condition, cannot eat when he is unconscious or unable to swallow.
- The patient should not eat food - this is a condition of acute pancreatitis or bleeding in the gastrointestinal tract.
- A sick person refuses food, then forced enteral feeding is used. What is it when such a state arises? This happens with anorexia nervosa, in which it is impossible to immediately load the stomach with ordinary food, since there is a danger of death after a long absence of food. Also, with various infections, the patient may refuse to eat, in which case an enteral nutrition system is used to fill the body with the necessary nutrients to fight this infection.
- Food does not meet the needs, this happens with injuries, catabolism, burns.
This type of nutrition is also prescribed for the following pathological conditions of the body:
- lack of protein and energy in the body, if it is not possible to ensure the intake of these substances in a natural way;
- in the event of various neoplasms in the head, stomach and neck;
- if there are progressive diseases of the central nervous system, eg Parkinson's disease, cerebrovascular stroke, various states of unconsciousness;
- in oncological conditions after radiation and chemotherapy;
- often such nutrition is prescribed for severe diseases of the gastrointestinal tract: pancreatitis, pathological processes in the liver and biliary tract, malabsorption syndromes and short intestine, as well as Crohn's disease;
- immediately after surgery on the body;
- for burns and acute poisoning;
- fistulas, sepsis;
- if complicated infectious diseases develop;
- for severe depression;
- at various degrees of radiation damage to a person.
Methods of administering nutritional mixtures
Enteral nutrition of patients differs by the method of eating:
- Using a tube to introduce the mixture into the stomach.
- "Sipping" method of eating - taking special food orally in small sips.
These methods are also called passive and active. The first is enteral tube feeding, infusion occurs using a special system and a dispenser. The second is active, manual, carried out mainly with a syringe. To use this method, it is necessary to collect a certain amount of the mixture and inject gently into the oral cavity of a sick person. To date, the advantage is given to infusor pumps, which automatically supply the mixture.
Probes for enteral nutrition
Many relatives of patients ask: enteral nutrition - what is it and what means are needed for this? Indeed, for this method of filling the body with food, different probes are needed. They are divided into:
- nasogastric (nasoenteric) - thin plastic probes that have holes at a certain level, as well as weights for ease of insertion;
- percutaneous - inserted after surgery (pharyngoscopy, gastrostomy, esophagostomy, jejunostomy).
Modes of providing nutrition to the body
Understanding this issue, enteral nutrition - what it is, is not enough for its implementation. There are many nuances of introducing food into the body in this way, for example, the feed rate of the mixture. There are several modes of receiving nutrition by the patient.
Naturally, these regimens cannot be adjusted to all patients who need enteral nutrition. The selection of the method, speed and volume of such a supply of food to the body takes into account individual characteristics.
Formula selection considerations
Enteral nutrition formulas should also be selected according to individual patient needs. Their choice depends on several factors.
It should be noted that formula for children, as well as solutions prepared from natural products, are not suitable for enteral nutrition. They are not balanced for an adult, so they cannot bring the desired result. For patients in need of such nutrition, their own types of mixtures have been developed, which we will consider below.
Monomer mixtures
The name of the mixtures determines their purpose. They do not contain the entire necessary set of trace elements, but are also used in such mixtures, which consist of glucose and salts, which makes it possible to restore the functionality of the small intestine immediately after surgery. In the presence of vomiting or diarrhea, such nutrition well maintains the water and electrolyte balance in the human body. Such mixtures include Gastrolit, Mafusol, Regidron, Citroglucosolan, Orasan and some others.
Elemental Nutrition Mixes
This nutritional supplement for patients is formulated with precisely selected chemical elements. They are used in specific cases of metabolic disorders in the body with pathologies such as liver and kidney failure, diabetes mellitus and pancreatitis. In this case, the pancreas, liver and kidneys cannot perform their specific functions, therefore such mixtures help a person at least partially restore vital activity. This type of nutrition includes Vivonex, Flexical, Lofenalak and others.
Semi-elemental formulas
These nutritional formulas for patients are used more often than the previous ones. This is due to the fact that they are already more balanced and suitable for a wide range of patients requiring enteral nutrition. Here, proteins are already in the form of amino acids and peptides, which allows them to be more easily absorbed in the body. Such solutions are used immediately after operations in violation of the digestive function of the body. These include Nutrien Elemental, Nutrilon Pepti TSC, Peptisorb, Peptamen.
Standard polymer blends
This type is used for many post-surgery ailments when the person is in a coma. They are the most suitable for an adult body in their composition. Such solutions contain all the necessary minerals, trace elements, proteins, fats, carbohydrates. They are divided into three types.
- Dry, which must be diluted and introduced into the body through a tube. This is the following enteral nutrition: Nutrizon, Berlamin Modular, Nutricomp Standard.
- Liquid, which can be administered immediately. They are designed for situations where there is not a minute to lose, supplying vital nutrition to a person. These include Berlamin Modular, Nutricomp Liquid, Nutrizon Standard and some others.
- Mixtures for oral use. These are "Nutridrink", "Forticrem" and so on.
Directional mixtures
This type of nutrition is similar in purpose to the elemental type of mixtures. They are designed to restore the functionality of the body in a specific pathology. They correct metabolic disorders in respiratory failure, impaired kidney and liver function, and immunity.
The laws in force in Russia, the European Union and the USA are written in such a way that prisoners on hunger strike have no chance to complete their mission. If the protester is on the verge of death, the prison administration will be obliged to transfer him to forced feeding. The World Medical Association has a special opinion: they believe that doctors should respect the prisoner's right to voluntary death.
Ukrainian director Oleg Sentsov, who is serving a sentence in the Polar Bear colony for creating "terrorist community", has been on hunger strike for more than 40 days, demanding the release of political prisoners. Russian cinematographers supported Sentsov: Nikita Mikhalkov, Andrei Zvyagintsev, Alexei German Jr. and others.
Verkhovna Rada Commissioner for Human Rights Lyudmila Denisova stated that, in her opinion, Oleg Sentsov could be force-fed in Russia.
“Forced feeding is cruel, inhuman and degrading treatment prohibited by international law,” the Ombudswoman wrote on her Facebook page.
Russian laws
Very little attention has been paid to the concepts of "hunger strike" and "force-feeding" in Russian legislation.
The key rule we have on this issue is Article 101 of the Penal Code of the Russian Federation "Medical and sanitary support for those sentenced to deprivation of liberty. " Paragraph 4 refers to hunger strikes:
“In cases where the convict refuses to eat and there is a threat to his life, forced feeding of the convict is allowed for medical reasons.”
The main message is not to let die. Everything else doesn't matter.
In comparison, suspects and defendants in criminal cases who went on a hunger strike have much more rights. They have "their" federal law, adopted back in 1995, - "On the detention of suspects and accused of committing crimes." In it, article 42 describes the procedure for dealing with the hungry:
- the head of the administration is obliged to find out the reasons for not eating;
- if the refusal is justified, the administration satisfies the requirements;
- if this cannot be done immediately, then give explanations "why" and take measures to satisfy the requirements;
- if possible, a person who refuses to eat is kept separately from other prisoners and under medical supervision;
- force-feeding is used if the life of a prisoner is in danger, on the basis of a written opinion of a doctor and in the presence of a health worker.
This document has nothing to do with Sentsov. In addition to the already mentioned article 101 of the Penal Code of the Russian Federation, the director convicted of terrorism is affected by the following act - the order of the Ministry of Justice on the approval of the norms for feeding prisoners, in particular, the “norm for forced feeding”:
- semolina or oatmeal - 50 grams;
- meat for broth - 200 grams;
- cow butter - 30 grams;
- chicken egg - 2 pieces;
- sugar - 100 grams;
- cow's milk - 800 milliliters;
- table salt - 10 grams;
- ascorbic acid - 100 milligrams.
The peculiarity of this kit is that without the use of physical violence (with the help of a dropper), only glucose (sugar) and ascorbic acid can be given to prisoners.
American laws
However, across the ocean, the attitude of prisoners to the right to hunger strike does not differ much from Russian norms.
The Code of Federal Regulations has an entire chapter devoted to food refusal in the Code of Federal Regulations (part 549)., subpart E) - Hunger Strikes.
The logic of the American legislators was the same as that of their Russian counterparts, who wrote the norms for the SIZO. Unless the document for the States came out more detailed.
The Americans brought to the top the most important norm in their opinion: "The Bureau of Prisons is responsible for the health of prisoners and for life-saving procedures." In this sense, the Russian law looks even more progressive: in our country, first of all, we need to find out what caused the hunger strike.
Then there are details in American law that we lack. For example, the definition: "What is a hunger strike?". In the United States, it begins after 72 hours have elapsed from the moment when the prisoner announced the refusal of food or when the administration discovered that the prisoner was not eating.
After that, the starving person is sent for a medical examination, where they check not only the physiological parameters of his body, but also the psyche for deviations. If problems are found, treatment is mandatory. And so throughout the entire period of fasting.
In American prisons, prisoners who are on a hunger strike are given food, enough water, and other drinks by staff in their room (or cell) three times a day. At the same time, food “from the will” cannot be eaten in the hunger strike mode.
If a prisoner's life or health is in danger, the doctor must first try to convince the starving person to voluntarily accept treatment. If it does not work out, they will be forced to save, even when the starving person is against such measures.
EU view
The European Court of Human Rights periodically receives cases of hunger strikes in prisons and force-feeding.
The practice of considering such applications shows that in Europe the priority is to save the life of a prisoner, even if this requires resorting to force-feeding. The main requirement is that it does not develop into torture.
In 2005, the ECtHR considered the case of banker Yevhen Nevmerzhitsky, who was force-fed in a Ukrainian prison. The very fact that the prisoner was given food against his will, the court considered normal (for medical reasons), but how exactly the Ukrainian guards acted (they used handcuffs, a mouth dilator, a special tube inserted into the esophagus for feeding) was regarded as torture .
In 2006, the court saw no crime in the actions of the Georgian authorities, who ignored the 115-day hunger strike of the defendant named Panjikidze.
In 2007, the judges of the ECtHR again equated torture and force-feeding. Oppositionist from Moldova Tudor Ciorap, who worked at the Center for the Investigation and Protection of Human Rights before imprisonment, was not only not allowed to go on a hunger strike. He was deliberately force-fed, although he himself agreed to the drip option.
In 2015, the ECtHR acquitted the Swiss authorities. A drug addict from this country, once in prison, began a hunger strike, seeking the legalization of cannabis. Having brought himself to exhaustion, the young man demanded to be released, saying that he could not be in prison in such a state. However, the guards decided that force-feeding would be the best alternative. The ECtHR agreed with them.
Special opinion
The only major public organization that opposes forced feeding of prisoners in any form is the World Medical Association.
WMA consolidated its point of view “the patient has the right to decide his own fate” in two declarations: Tokyo from 1975 and Malta from 1991.
According to the WMA, the medical professional who works with a prisoner who decides to refuse food faces a dilemma as to which of two medical principles to follow: either do no harm to the patient or respect his right to refuse treatment. The organization believes that it is necessary to follow the second.
At the same time, the doctor must make sure that the prisoner has decided to participate in the hunger strike consciously and voluntarily (this is especially important during mass hunger strikes), that he fully understands what he is doing and what the outcome will be.
