The Verkhovna Rada yesterday approved in the first reading a draft law toughening the requirements for the production of baby food. The document obliges to produce baby food only at specialized enterprises or on separate production lines that have an operational permit, as well as carry out state registration of products. According to experts, the proposed changes may lead to a rise in the price of baby food.

People's deputies yesterday adopted in the first reading amendments to the law "On baby food", according to which food products for children can only be produced at specialized enterprises or separate technological lines with operating permits. In the current legislation, for the production of baby food, it is enough to comply with sanitary requirements and safety precautions.

The bill obliges Ukrainian companies to use products grown in special raw material zones for baby food, as well as undergo the procedure for state registration of products. These requirements are not imposed on foreign companies importing baby food to Ukraine - their products must only comply with the mandatory safety parameters and minimum quality specifications approved by the central executive authority for healthcare.

The capacity of the baby food market in Ukraine in 2009 amounted to 1.4 million tons. Only 5.8 thousand tons of baby juices, 11.7 thousand tons of milk-based baby food products, 3.7 thousand tons of breast milk substitutes, 8 thousand tons of liquid and pasty products. Meat and fish purees and therapeutic and preventive nutrition are not produced in the country, and fruit and vegetable and fruit purees are in small quantities. (See Kommersant of June 18, 2009).

As the author of the document, People's Deputy Tatyana Bakhteyeva (Party of Regions), explained to Kommersant, a special resource zone is a territory where there is no industrial equipment, factories, mines that pollute the environment. "We are strengthening control over the production of baby food because the quality of domestic products for children leaves much to be desired," she said. According to Ms. Bakhteyeva, after the new law comes into force, baby food that does not meet the new parameters will be withdrawn from trade.

Yesterday, experts assessed the effectiveness of the proposed changes in different ways. According to Gennady Radchenko, head of the public relations department at Nestle Ukraine, the bill will improve the quality of baby food products, since it lifts the ban on the addition of starch and wheat flour. It is noteworthy that on June 26, 2009, the Kyiv prosecutor's office challenged the certificates of conformity for the products of a number of importers of baby food because of their non-compliance with the law "On Baby Food", which prohibits the addition of wheat flour and starch.

The bill also prohibits the use of flavors, colors, preservatives, stabilizers, flavor enhancers and fragrances. According to the professor of the Department of Food Hygiene of the National Medical University. Bogomolets Ignat Matassar, the absence of these substances can narrow the range. According to him, these ingredients are used in order to give a beautiful appearance or increase the shelf life of these products. "Some baby food products cannot be produced at all without substances that are harmful to the health of the baby," says Mr. Matassard.

Aleksandra Kuzhel, head of the State Committee for Entrepreneurship, is confident that the proposed changes will lead to higher prices for products. According to her, only the state registration of a product (collection of documentation, analysis of samples, suppliers, etc.) can cost about UAH 150-200 thousand. “Perhaps, if such a law is adopted as a whole, many domestic producers will leave the market altogether, since the production of baby food is not a highly profitable and not very lucrative business,” Ms. Kuzhel suggested.
