The Perm prosecutor's office ordered the region's authorities to pay for baby food

The Supreme Court of the Russian Federation figured out who should allocate funds for the purchase of dairy products for children under the age of three in the Kama region. He assigned this responsibility to the government of the Perm Territory.

By the decision of the Supreme Court of Russia, part of the program of state guarantees for the provision of free medical care to the population of the Perm Territory was declared invalid. Only one paragraph was repealed, but it was critical to providing young children with dairy products.

The fact is that earlier baby food was purchased at the expense of local budgets of cities and districts of the region.

    - Every year we receive complaints from young mothers about the refusal to receive dairy products, - says Pavel Mikov, Commissioner for Children's Rights in the Perm Territory. - Most of the municipalities, having no money, have closed dairy kitchens and give dry milk mixtures instead of fresh products. There are especially many complaints from large cities - Tchaikovsky, Berezniki, Gubakha and others.

Due to the lack of funds in the districts of the region, baby food was sometimes given only to those children whose age had not reached one year - the rest were refused.

The Perm prosecutor's office insisted that the financing of expenses for dairy products from municipal budgets is illegal, and the regional authorities should allocate money for this.

In March of this year, the supervisory authority filed an application with the Perm Regional Court with a request to invalidate the part of the regional program, which referred to the provision of children with food at the expense of local authorities.

At the same time, the prosecutor's office argued that the regional authorities that prepared this document did not have the right to entrust municipalities with the authority to provide dairy products to children without transferring the necessary funds to them.

In addition, in its statement, the supervisory authority indicated that "the specified program restricts the rights of an indefinite circle of minors under the age of three years to provide them with good nutrition."

However, the Perm Regional Court did not agree with the arguments of the prosecutor's office.

The judges decided that the issue of child nutrition was not within the jurisdiction of the regional authorities. They classified it as primary health care, which should be organized by the municipalities. The Perm court considered that children's nutrition is outpatient care, which is the prerogative of the district and city authorities of the Kama region.

As a result, the prosecutor's statement was not satisfied.

Prosecutor of the Perm Territory Alexander Belykh appealed this decision to the Supreme Court of Russia. After reviewing the documents, the main judicial instance of the country did not agree with the opinion of the Perm colleagues.

In its decision, the Supreme Court pointed out that the Perm "court erroneously considered that the provision of dairy products to children in the first and second years of life belongs to the types of primary health care and is an obligation of local governments."

In addition, the highest court drew attention to the fact that, in accordance with federal law, free provision of children with baby food does not apply to issues of municipal districts.

After that, the Judicial Collegium for Administrative Cases of the Supreme Court of Russia determined that the part of the regional program of state guarantees for the provision of free medical care to the population of the Perm Territory, disputed by the prosecutor's office, is invalid. This decision has entered into force.

    - The Legislative Assembly of the Perm Territory has already made the necessary changes to the regulations - said Pavel Mikov. - Starting from October of this year, money for the purchase of dairy products for children will come from the regional budget. I would like to hope that the situation with baby food in the Kama region will change for the better.

As RG was informed in the Ministry of Health of the Perm Territory, the cost of food for children under the age of three will be covered by the regional budget. The costs of municipalities for the period from July to December of this year to provide dairy products to children will be compensated.
